Impartiality & Power Imbalance (ETHICS)

Join Karen Anderson as she leads us in an investigation and discussion around the dynamics that arise during the pre-mediation and the mediation processes that make us question how to employ our ethical responsibilities. We will define terms, visit research, and share experiences as we clarify what impartiality means and review what power ADR professionals have. We will also investigate how to recognize and manage power imbalances between or among clients. In addition, we will consider kinds of power, conflict management styles, “children’s best interests,” and guidelines for behavior and language use as these factors impact our impartiality and our clients’ power. Whether your clients are parents, partners, coworkers, consumers, neighbors, adversaries, adolescents—this program recognizes the human interactions and ethics Mo at play under our structural guidance as they work toward satisfactory resolutions.
